Defense of Marriage Act Dead!

Historic victories have been made today in the wake of the U.S. Supreme Court’s overturn of the Defense of Marriage Act (DOMA) and rejecting the California marriage ban Proposition 8, allowing same-sex couples to resume marriage in the State of California. With the repeal of DOMA, this means that same-sex couples who marry in states where it’s legal for them to do so will be treated the same as heterosexual married couples by the U.S. Federal Government when it comes to things like retirement befits, taxes and immigration.

More to come on the immigration benefits for same-sex couples in the following weeks. We, at JCS Immigration and Visa, are very happy to welcome the new equality for same-sex binational couples seeking to petition their spouse for a green card.
